Hadith 591:1

Rawh narrated to us, Ibn Jurayj narrated to us, Ikrima ibn Khalid informed me, from Usayd ibn Hudayr al-Ansari—then one of the Banu Haritha—that he informed him that he was a governor over al-Yamama, and that Marwan wrote to him: "That Mu'awiya wrote to him: 'Whichever man has a theft stolen from him, he is more entitled to it for the price wherever he finds it.'" He said: "So I wrote to Marwan: 'That the Prophet, peace and blessings of Allah be upon him, decreed that if the one who bought it from the one who stole it is not suspected, the owner of it is given a choice: if he wishes, he may take the price from the one who stole it from him, and if he wishes, he may pursue the thief.'" He said: "And Abu Bakr, Umar, and Uthman, may Allah be pleased with them, decreed the same."

حدثنا روح، حدثنا ابن جريج، أخبرني عكرمة بن خالد، عن أسيد بن حضير الأنصاري، ثم أحد بني حارثة، أنه أخبره أنه كان عاملا على اليمامة، وأن مروان كتب إليه: أن معاوية كتب إليه: أيما رجل سرق منه سرقة، فهو أحق بها بالثمن حيث وجدها، قال: فكتبت إلى مروان: " أن النبي صلى الله عليه وسلم قضى أنه إذا كان الذي ابتاعها من الذي سرقها غير متهم، خير سيدها، فإن شاء أخذ الذي سرق منه بالثمن، وإن شاء اتبع سارقه "، قال: وقضى بذلك أبو بكر، وعمر، وعثمان رضي الله تعالى عنهم
