Hadith 91:1
Abu ‘Amir narrated to us, ‘Abd al-Malik—meaning Ibn Hassan al-Harithi—narrated to us, ‘Abd al-Rahman ibn Abi Sa‘id narrated to us, he said: I heard ‘Umarah ibn Harithah al-Damri narrating from ‘Amr ibn Yathribi al-Damri, he said: I witnessed the sermon of the Messenger of Allah, may Allah bless him and grant him peace, at Mina. Among what he said in his sermon was: "It is not lawful for a person to take the wealth of his brother except for that which he gives willingly." He said: When I heard that, I said: "O Messenger of Allah, what if I encounter the sheep of my cousin and I take a sheep from them and slaughter it? Is there any sin upon me in that?" He said: "If you encounter it as a ewe carrying a knife and a fire-striker, then do not touch it."
حدثنا أبو عامر، حدثنا عبد الملك يعني ابن حسن الحارثي، حدثنا عبد الرحمن بن أبي سعيد، قال: سمعت عمارة بن حارثة الضمري يحدث، عن عمرو بن يثربي الضمري، قال: شهدت خطبة رسول الله صلى الله عليه وسلم بمنى، فكان فيما خطب به أن قال: " ولا يحل لامرئ من مال أخيه إلا ما طابت به نفسه " قال: فلما سمعت ذلك قلت: يا رسول الله، أرأيت لو لقيت غنم ابن عمي فأخذت منها شاة فاجتزرتها؟ هل علي في ذلك شيء؟ قال: " إن لقيتها نعجة تحمل شفرة وزنادا فلا تمسها " . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .
