Hadith 1112:1
Ya'qub narrated to us, my father narrated to us, from Muhammad ibn Ishaq, Muhammad ibn Ja'far ibn al-Zubayr narrated to me, he said: I heard Ziyad ibn Damirah ibn Sa'd al-Sulami narrating to 'Urwah ibn al-Zubayr, from his father Damirah, and from his grandfather, and they both had witnessed Hunayn with the Messenger of Allah, may Allah bless him and grant him peace. They both said: The Messenger of Allah, may Allah bless him and grant him peace, prayed Dhuhr with us, then he headed toward the shade of a tree and sat in it, while he was at Hunayn. Al-Aqra' ibn Habis and 'Uyaynah ibn Hisn ibn Hudhayfah ibn Badr stood up to him, disputing over 'Amir ibn al-Adbat al-Ashja'i. 'Uyaynah was seeking the blood-money for 'Amir, and he was on that day the chief of Ghatafan. Al-Aqra' ibn Habis was defending Muhallim ibn Juththamah due to his status among Khindif. They exchanged the dispute before the Messenger of Allah, may Allah bless him and grant him peace, while we were listening. We heard 'Uyaynah saying: "By Allah, O Messenger of Allah, I will not leave him until I make his women taste of the heat [of grief] what my women have tasted." The Messenger of Allah, may Allah bless him and grant him peace, was saying: "Rather, you shall take the blood-money: fifty [camels] in this journey of ours, and fifty when we return." He said: But he refused him. Then a man from Banu Layth stood up, who was called Mukaytal, short and compact, and he said: "O Messenger of Allah, by Allah, I have not found a likeness for this slain man in the early days of Islam except as sheep that came to water, and their first ones were shot at, so their last ones fled. Establish a precedent today and change it tomorrow." He said: The Messenger of Allah, may Allah bless him and grant him peace, raised his hand, then said: "Rather, you shall take the blood-money: fifty in this journey of ours, and fifty when we return." He said: So they accepted the blood-money. Then they said: "Where is your companion so that the Messenger of Allah may ask for forgiveness for him?" He said: A dark-skinned, lean, tall man stood up, wearing a garment of his, having prepared himself in it for death, until he sat before the Messenger of Allah, may Allah bless him and grant him peace. He said: "What is your name?" He said: "I am Muhallim ibn Juththamah." He said: The Messenger of Allah, may Allah bless him and grant him peace, raised his hand, then said: "O Allah, do not forgive Muhallim ibn Juththamah." He stood up, and he was catching his tears with the edge of his garment. He said: As for us among ourselves, we say: We hope that the Messenger of Allah, may Allah bless him and grant him peace, has asked for forgiveness for him, but as for what appeared from the Messenger of Allah, may Allah bless him and grant him peace, it is this.
حدثنا يعقوب، حدثنا أبي ، عن محمد بن إسحاق، حدثني محمد بن جعفر بن الزبير، قال: سمعت زياد بن ضميرة بن سعد السلمي، يحدث عروة بن الزبير، عن أبيه ضميرة، وعن جده، وكانا شهدا حنينا مع رسول الله صلى الله عليه وسلم، قالا: صلى بنا رسول الله صلى الله عليه وسلم الظهر ثم عمد إلى ظل شجرة فجلس فيه وهو بحنين، فقام إليه الأقرع بن حابس، وعيينة بن حصن بن حذيفة بن بدر، يختصمان في عامر بن الأضبط الأشجعي، وعيينة يطلب بدم عامر، وهو يومئذ رئيس غطفان، والأقرع بن حابس يدفع عن محلم بن جثامة بمكانه من خندف، فتداولا الخصومة عند رسول الله صلى الله عليه وسلم، ونحن نسمع، فسمعنا عيينة وهو يقول: والله يا رسول الله لا أدعه حتى أذيق نساءه من الحر ما ذاق نسائي، ورسول الله صلى الله عليه وسلم يقول: " بل تأخذون الدية: خمسين في سفرنا هذا، وخمسين إذا رجعنا " قال: وهو يأبى عليه إذ قام رجل من بني ليث يقال له: مكيتل، قصير مجموع، فقال: يا رسول الله، والله ما وجدت لهذا القتيل شبها في غرة الإسلام إلا كغنم وردت فرميت أوائلها فنفرت أخراها، اسنن اليوم وغير غدا، قال: فرفع رسول الله صلى الله عليه وسلم يده، ثم قال: " بل تأخذون الدية خمسين في سفرنا هذا، وخمسين إذا رجعنا " قال: فقبلوا الدية، ثم قالوا: أين صاحبكم يستغفر له رسول الله؟ قال: فقام رجل آدم ضرب طويل، عليه حلة له، قد كان تهيأ فيها للقتل حتى جلس بين يدي رسول الله صلى الله عليه وسلم، فقال: " ما اسمك؟ " قال: أنا محلم بن جثامة، قال: فرفع رسول الله صلى الله عليه وسلم يده ثم قال: " اللهم لا تغفر لمحلم بن جثامة "، قم فقام وهو يتلقى دمعه بفضل ردائه، قال: فأما نحن بيننا فنقول: إنا نرجو أن يكون رسول الله صلى الله عليه وسلم قد استغفر له، وأما ما ظهر من رسول الله صلى الله عليه وسلم فهذا
