Hadith 946:1

Waki’ narrated to us, Hisham bin Sa’d narrated to us, Yazid bin Nu’aym bin Hazzal informed me, from his father, who said: Ma’iz bin Malik was under the care of my father, and he committed [adultery with] a slave girl from the tribe. My father said to him: "Go to the Messenger of Allah, may Allah bless him and grant him peace, and inform him of what you have done, perhaps he will seek forgiveness for you." He only intended by that the hope that there would be a way out for him. So he came to him and said: "O Messenger of Allah, I have committed adultery, so establish the Book of Allah upon me." He turned away from him. He returned and said: "O Messenger of Allah, I have committed adultery, so establish the Book of Allah upon me." He turned away from him. Then he came to him a third time and said: "O Messenger of Allah, I have committed adultery, so establish the Book of Allah upon me." Then he came to him a fourth time and said: "O Messenger of Allah, I have committed adultery, so establish the Book of Allah upon me." The Messenger of Allah, may Allah bless him and grant him peace, said: "You have said it four times, so with whom?" He said: "With so-and-so." He said: "Did you lie beside her?" He said: "Yes." He said: "Did you touch her?" He said: "Yes." He said: "Did you have intercourse with her?" He said: "Yes." He said: So he ordered that he be stoned. He said: So he was taken out to the Harrah [stony tract]. When he was stoned and felt the pain of the stones, he became distressed and ran away. Abdullah bin Unays met him, and he had outrun his companions, so he pulled out the shank of a camel and threw it at him, and killed him. He said: Then he came to the Prophet, may Allah bless him and grant him peace, and mentioned that to him. He said: "Why did you not leave him? Perhaps he would have repented, and Allah would have accepted his repentance." Hisham said: Yazid bin Nu’aym bin Hazzal narrated to me, from his father: That the Messenger of Allah, may Allah bless him and grant him peace, said to my father when he saw him: "By Allah, O Hazzal, if you had covered him with your garment, it would have been better than what you did to him."

حدثنا وكيع، حدثنا هشام بن سعد، أخبرني يزيد بن نعيم بن هزال، عن أبيه، قال: كان ماعز بن مالك في حجر أبي، فأصاب جارية من الحي، فقال له أبي: ائت رسول الله صلى الله عليه وسلم فأخبره بما صنعت، لعله يستغفر لك. وإنما يريد بذلك رجاء أن يكون له مخرج، فأتاه فقال: يا رسول الله، إني زنيت، فأقم علي كتاب الله. فأعرض عنه، فعاد، فقال: يا رسول الله، إني زنيت، فأقم علي كتاب الله. فأعرض عنه ، ثم أتاه الثالثة، فقال: يا رسول الله، إني زنيت، فأقم علي كتاب الله. ثم أتاه الرابعة، فقال: يا رسول الله، إني زنيت، فأقم علي كتاب الله. فقال رسول الله صلى الله عليه وسلم: " " إنك قد قلتها أربع مرات، فبمن؟ " " قال: بفلانة. قال: " " هل ضاجعتها؟ " " قال: نعم. قال: " " هل باشرتها؟ " " قال: نعم. قال: " " هل جامعتها؟ " " قال: نعم . قال: فأمر به أن يرجم، قال: فأخرج به إلى الحرة، فلما رجم، فوجد مس الحجارة، جزع، فخرج يشتد، فلقيه عبد الله بن أنيس، وقد أعجز أصحابه، فنزع له بوظيف بعير، فرماه به، فقتله، قال: ثم أتى النبي صلى الله عليه وسلم، فذكر ذلك له، فقال: " " هلا تركتموه لعله يتوب، فيتوب الله عليه " " قال هشام: فحدثني يزيد بن نعيم بن هزال، عن أبيه: أن رسول الله صلى الله عليه وسلم قال لأبي حين رآه: " " والله يا هزال، لو كنت سترته بثوبك، كان خيرا مما صنعت به " . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .
