Hadith 375:1
Yahya ibn Ishaq narrated to us, he said: Ibn Lahi'ah narrated to us, from Ubayd Allah ibn Abi Ja'far, from al-Fadl ibn 'Amr ibn Umayyah, from his father, who said: I heard men speaking about the Prophet, may Allah bless him and grant him peace, that he said: "If a slave woman is emancipated, she has the choice [to remain or leave] as long as he has not had sexual intercourse with her. If she wishes, she may separate from him. But if he has had sexual intercourse with her, then she has no choice, and she cannot separate from him."
حدثنا يحيى بن إسحاق، قال: حدثنا ابن لهيعة، عن عبيد الله بن أبي جعفر، عن الفضل بن عمرو بن أمية، عن أبيه قال: سمعت رجالا يتحدثون، عن النبي صلى الله عليه وسلم أنه قال: " إذا أعتقت الأمة فهي بالخيار ما لم يطأها، إن شاءت فارقته، وإن وطئها فلا خيار لها، ولا تستطيع فراقه " . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .
