Hadith 375:2
Hassan narrated to us, he said: Ibn Lahi'ah narrated to us, he said: Ubayd Allah ibn Abi Ja'far narrated to us, from al-Fadl ibn al-Hasan ibn 'Amr ibn Umayyah al-Damri, he said: I heard men from the companions of the Messenger of Allah, may Allah bless him and grant him peace, talking that the Messenger of Allah, may Allah bless him and grant him peace, said: "If a slave woman is emancipated while she is under a slave, then her affair is in her own hands. If she remains [with him] until he has intercourse with her, then she is his wife; she cannot separate from him."
حدثنا حسن، قال: حدثنا ابن لهيعة، قال: حدثنا عبيد الله بن أبي جعفر، عن الفضل بن الحسن بن عمرو بن أمية الضمري قال: سمعت رجالا من أصحاب رسول الله صلى الله عليه وسلم يتحدثون، أن رسول الله صلى الله عليه وسلم قال: " إذا أعتقت الأمة وهي تحت العبد فأمرها بيدها، فإن هي أقرت حتى يطأها فهي امرأته لا تستطيع فراقه "
